    It doesn’t matter if it isn’t, legal debates regarding the topic are irrelevant to ownership. The level of ignorance to consistently ignore the fact that this is arguably among the worst crimes globally; in the name of some sort of opposition to censorship, is ridiculous

      The public comment sections and chatrooms are fundamentally server-side 😭🙏🏽💔

      If User A posts a link to illegal material, and User B (miles away) can see and click that link, that data must pass through and be hosted by Perchance’s servers to sync the chatroom. It is not “local.” Furthermore, federal criminal laws regarding child safety completely override standard civil liability exemptions. You cannot code your way out of a federal crime by claiming, “We don’t use logins.” If federal contraband is being distributed across your network infrastructure and you are notified, which they absolutely have been; you are exposed.

      And the material is a mix of both what is generated, and literal real life child exploitation

      There is a massive difference between “evading automated censorship” and “evading federal criminal prosecution.” Operating as a “decentralized sandbox” or keeping a “low profile” does not grant a platform a magical invisibility cloak against the law.

        How the Law Sees It: Under established internet law, a platform is not required to prevent every single bad thing from happening in real-time. It is required to provide a mechanism for users to report abuse and a process to remove illegal content once they are made aware of it.

        Good Samaritan Protections: Under Section 230, platforms are actually encouraged to use automated filters and community reporting. The law protects developers who make a “good faith” effort to moderate their platforms, even if some bad content occasionally slips through the automated cracks.

          Nothing has been, that’s the issue. Someone literally leaked their trafficking profile on Telegram, on there; and absolutely nothing has been done. People still, actively distribute said materials and nothing has been done. “Not reporting everything” implies there’s been some for, of actual active effective moderation, where there has not

          S-230 is nullified under both negligence and the distribution of CSM, I explained this in the prior thread

        Chatrooms as one of the worst global crimes, that is wild. You know the website that you are using has no identification of its users, and creators of generators can choose to have chat if they want to which you can choose to join or not join. If you want to take action against Perchance you’re welcome to try.

          There is absolutely nothing intellectually inconsistent about it And the creation of the specific gen in question, is the developer themself You could, at minimum, moderate the room or assign moderators so the issue can be avoided entirely

            So, you expect a group of people to basically monitor chats for every particular generator on Perchance that codes in a comments panel? In addition to the AI moderation that is already present. That is impossible in real time. Literally impossible in real time. There is an automated system which is an effort, an attempt. But only so much can be done to manage anonymous users.

              Yes, I expect basic HUMAN moderation considering the site is now an arguable high risk intermediary; I cannot stress this enough

              This will legally come to screw the site later, so; it’s either moderate the damn official generators, or just pull the plug entirely

                New Comment panels are popping up every day on new generators, the gen creators and AI moderation is at play. Perchance is not required to have 24/7 human moderation, this is not some sort of new phenomenon. Creators code those chatrooms in because they want to have have them embedded in their gens and have the freedom to do that. You think that you can bully the Dev into forcing people to not code chatrooms, it’s really brazen.
