Lmao, “no reasonable customer would expect the thing with the word “rib” in the name and shaped like ribs to be made of rib meat.”

Sure, it’s obviously not literally a rack of ribs but clearly they are trying to associate it with a fancier product by way of naming and shape it like that. Probably wouldn’t sell as well if it was called the McTripe. That’s pretty deceptive and misleading.

Is it that big of a deal? Not really, but also it’s just one example out of a mountain of examples of McDonald’s misleading or manipulating customers.

I mean this article is more sensationalist than anything else around it. This is a non-story.

The judge here hasn’t implied that the McRib is or isn’t deception. They’ve just ruled that the question is valid enough to warrant a court hearing.

McDonalds tried to dismiss the question as obviously absurd. The judge hasn’t even really disagreed with that, except that it isn’t immediately obviously absurd. “McRib” + kinda rib shaped = maybe a claim of it being ribs? Worth a bigger discussion, at least.

The facts presented in the hearing will play it out, and realistically McD’s will probably win. The McRib is priced the same as their other fast food offerings, and far less than an actual set of ribs would be. I mean, it’s kinda like arguing a “Big Mac” implies some special cut of beef, or a McNugget is a special type of chicken (it is, but not like that).

But McD’s still have to go to court and argue their case. And who knows, maybe they’ll blow it up massively in their face like that time they lost the European trademark for Big Mac.

Any Judge who rules against a megacorp in their hometown jurisdiction will likely not remain a Judge in that location very long.

no reasonable consumer could expect the McRib to contain rib meat

Sounds right to me. People will litigate anything.

This sounds a bit like people demanding that almond milk should be called “nut juice”.

Also: Buffalo wings have no buffalo.

      See there’s a difference here:

Buffalo don’t have wings, one can reasonably expect wings to be made of a creature that has wings. Also did you know that they’re named after Buffalo, the city where they were first made?

Pigs do have rib meat, so one can reasonably expect a rib sandwich to be made of primarily rib meat, not tripe and stomach. And unless the first place to make such sandwiches was a city called Rib, I’d say McRib is named after ribs or rib meat.

The wild part about the almond milk thing is that is existed since the middle ages and was used as a dairy milk substitute even back then and it’s been called almond milk for nearly the whole time. And yet now it’s somehow a problem.

Yeah. It’s weird how some of these industries fly into a panic and seek to suppress and mount campaigns against something that is an alternative, often a better alternative in many ways.

They get all litigious over calling something “milk” if it’s not dairy. They preemptively get states to outlaw what is likely one of the only serious ways to address global warming: cultured meat. Which is just bonkers - it’d be like Big Carbon getting states to simply outlaw wind and solar preemptively. Imagine, getting prison time for selling cultured meat.

These industries all have assets and the knowledge to get things onto shelves already; they could simply invest in the future as well.

If you look closel, instead of calling it nut juice they just invented a new word: Almondmilk. Check your fridge (if you chug nut juice). The lawyer that came up with this deserves a dinosaur sticker on their hand.

It’s all theater and distraction. Coconut milk has been around an awful long time with no issue. Same with milk of magnesia.

The dairy industry only started caring when the term milk started getting used for viable alternatives to dairy milk. Industrial lobbying is all about protecting market share and that’s it.

Mostly, yeah, but there are also kind of meatmaxxing/proteinmaxxing types that usually simp for the dairy industry, too.

An example would be any fucking moron that calls other people “soy boys” - highly likely to be one of these people that take issue with almond/soy/oat milk…

That makes no sense. Did they really do that? Gorditas are/were wildly unpopular (except for the CGC), but it took so much less effort to warm those up than it did to deep fry it into a Chalupa.

Yep. At least around me they did. And they refuse to make a gordita, and you can’t order a raw chalupa. They did bring it back this fall for a limited time, but I can’t go to my local taco bell anymore because they have flock cameras in the parking lot.

I really gotta get better at reading labels. Turns out they are made almost entirely out of…CORN!

The bears are made of corn! With a small amount of cow and/or pig.
